the as are play-off bound. how this improbable team made it so far. >> roger. got an unusual one for you. >> not exactly what you want to hear 30,000 feet up in the sky. the latest problem adding to american airline's woes. >> very mild around much of the bay area. now get ready for another hot day. we'll talk about that coming up. >> and so far, so good this morning if you're heading across the bay bridge. we'll have much more on your tuesday morning commute coming up. good morning, it's tuesday, october 2. i'm michelle griego. >> hi, everybody. i'm frank mallicoat. it's 5:00 and a little celebrating. you can probably still hear it over in oakland. but there's going to be a little post-season baseball upon both sides of the bay. >> the as beat the rangers. cbs 5 reporter elissa harrington is at the coliseum in oakland right now where the as are still looking to win their division. elissa, pretty exciting. >> reporter: it is exciting and hopefully they didn't celebrate

with too much champagne last night because they have another game today against the rangers if they want to win their division but the as have clinched a spot in the play- offs for the first time in six years, a big win over the texas rangers last night. the score was 4-3 and if you missed that strikeout in the 9th inning, here it is. >> he struck him out! and the oakland athletics -- >> reporter: this was the as fourth straight win in six of seven. more than 2 1,000 fans saw the six-year dry spell finally end. this is really a story about the underdogs coming up ahead. in the clubhouse, corks were flying, champagne flowing. this is a big deal because nobody expected it this year. the team is young. there are 15 rookies on the roster. and many of them actually played key roles in last

night's win like pitcher jarrod parker who held the rangers to three runs and six hits. the as took the lead in the 1st inning. the teams were then tied by the 4th. then coco crisp gave the as the lead the rangers couldn't catch. the athletics are headed to the post-season for the first time since 2006 taking one of the american league's two wild card play-off spots. >> when you look at the team when i was in spring training nobody gave it a chance. at least the people from the outside didn't give it a chance. what did you think? >> i think it was a mistake. we cannot a few articles and so we're going to lose 1030 games. none of us believed that. billy didn't believe at that time all. >> reporter: the as still have some work to do if they want to win their division but those hopes are alive. they need to sweep the rangers and they have a game tonight at 7:05. so very exciting for as fans, who have been waiting a long time for this, first time in six years heading to the play-

actually beach weather yesterday, lawrence hit the beach, it was gorgeous outside. hoping for a repeat. >> oh, it was just beautiful all the way to the coast. today a couple of degrees cooler. we are starting out very mild out the door. san francisco is 68 degrees right now. that's hard to believe. 63 degrees in livermore. 62 in san jose. as we head toward the afternoon, again, it is going to be hot in spots about 97 degrees in morgan hill. 93 san jose, east bay temperatures again pushing triple digits in some areas, maybe a couple of degrees cooler but not by much. 100 degrees in antioch. livermore 100. 89 in oakland, 92 degrees hayward, more on your weather coming up plus a major cooldown heading our way. more on that in a few minutes. new this morning, police in oakland are looking into a pair of deadly shootings overnight. both happened last night on

macarthur boulevard. it first happened on the 9000 block just before 9:00. a man was shot several times there. he died at the scene. the other was about an hour and a half later on the 2000 block same street macarthur boulevard. that mac also died at the scene. so far there are no suspects in either of those shootings. later this morning, the superintendent of a school district in albany will address the death of a teacher. james izumizaki was a 6th grade teacher at albany middle school. he was recently charged with lewd acts with a former student. he was arrested last wednesday and was out on bail when he was found dead in his car. the alameda county sheriff's office is now investigating the death as a suicide. today a san francisco man accused of kidnapping a girl in san mateo will be in court to enter a plea. bradley mrozek is accused of groping a 9-year-old girl at parkside elementary school and taking her off campus last month. police are still investigating this and again he will be in

court. 5:05 now. about 40 passengers on a train were seriously injured none seriously, the amtrak train was headed from oakland down to bakersfield. police say the driver did not yield at the crossing gates, slammed right into the train pushing at least one car off the tracks. >> how did you not see that the train was crossing the arms were down? i don't know if there's any indication of any use of alcohol or drugs. >> tracks could be cleared by about 7 a.m. until then a bus bridge is now taking passengers around that accident area. a local city leader says he wouldn't be intimidated. vallejo mayor osby davis's private law firm was purposely torched over the weekend gutting the building. davis says he has had numerous windows broken out in the past by rocks. he believes someone is trying to intimidate him. he says it's not working. >> i believe the last criminal act is part of an escalating

attempt to intimidate me. let me make it very, very clear: it has failed. >> the mayor and his family are not getting extra police protection despite the targeted attacks. more testimony is planned today in the trial of murder suspect giselle esteban accused of killing nursing student michelle le in hayward last year. in opening statements yesterday, prosecutors blamed a jealous rage for prompting esteban to kill her former friend. the defense contends the killing was not premeditated but done in the heat of passion. the body of one of two missing fishermen washed ashore on the san mateo county coast. he was aboard an 18-foot fishing boat when it capsized on sunday off pidgeon point. a second man is still missing. neither were wearing life jackets. two other men on board were wearing life jackets and made it safely to shore. richmond city council has a couple of resolutions about chevron on its agenda tonight. the council expected to approve

a resolution all aimed at making sure the oil company uses the highest standards and best technology when it repairs the refinery, that burned two months ago. the council is also expected to urge chevron to invest in research and office space in richmond's marina bay district. an east bay fire district now has job openings for firefighters. the federal grant of nearly 8 million bucksenabling the east contra costa district to rehire laid off firefighters and add more. they plan to restore 15 firefighters and hire 12 more in addition to. the fire chief is searching for qualified applicants and three fire stations that were closed over the summer will now reopen. final preparations are under way for the big showdown, the first debate between president obama and republican challenger mitt romney. the candidates will spend today getting ready for tomorrow's event in colorado. the president held no rallies yesterday but he did visit a

campaign office in henderson, nevada. it's not far from where he and his staff have been strategizing. romney spoke to a crowd of supporters at an air and space museum in denver. >> this president is taking us on a path that's not working. he is making us more and more like europe. i don't want to be like europe. europe doesn't work in europe. >> at the university of denver crews are putting on the final touches, transforming the arena into a debate set. yesterday just 92 of the university's students learned their names were drawn in a lottery for tickets to the debate. it's a hot ticket. your ticket to the debate is right here on cbs 5. that's beginning tomorrow evening at 6:00. nearly all americans will see higher taxes if congress fails to renew tax cuts. that's all according to a new report from the tax policy center. the two major parties are split on exactly who should continue to have the reduced taxes. if a plan is not passed by the end of the year, the existing tax cuts will come to an end.

as an example, a family earning $40,000 to $64,000 a year could see taxes go up as much as $2,000 by 2013. american airlines has engineers in new york checking the seats of 8 boeing 757 jets. the inspections came after two incidents where rows of seats came loose from airplanes' floors. it happened yesterday on a flight from new york to miami and on saturday on a boston-to- miami flight that made an emergency landing in new york because of pilot concerns. >> we don't know what kind of turbulence we have. the seat is loose. we don't want that thing flying around and hurting the passengers behind them. >> both planes recently had maintenance work that involved removing the seats. the work was done at separate facilities and american says the problem could be the way the seats fit in the tracks on the floor. the airline and the faa are still investigating. so we want to know, does the loose seat problem make you afraid to fly? comment on facebook or twitter

victoria harbor last night.e than 300- thousa the show, on look at that. thousands of fireworks lit the sky on fire own hong kong's victoria harbor last night. more than 300,000 people gathered for the show on china's national day. the holiday marks the anniversary of the founding of the people's republic of china. love fireworks. >> i'm a big fireworks fan, too. we have a little situation right now. some traffic up in vallejo because of i guess a three- alarm fire, is that right? >> yes, it has grown to three alarms. now they are getting mutual aid from other fire departments. it sounds pretty bad. it's in a residential neighborhood. there is a little confusion over the exact address, either the 100 or 200 block of el camino real. some of the close to the high

school. avoid it. you can use nebraska heading towards the high school. this is a little early at 5:15. and again, three-alarm fire right now. we are sending a crew to the scene so they should be there very shortly. in the meantime, if you are continuing down the eastshore freeway, westbound 80, not a bad ride on the road so far this morning. good through ashby as you make your way towards berkeley. and into the san francisco area, once again we have been talking about this for a while now for at least much of this week started last week, oracle open world they have those street closures on howard between 3rd and 4th causing bad traffic tie-ups south of market. it is no longer a "spare the air" day even though it's going to be hot again. we'll talk to lawrence in a minute. but yeah, no "spare the air" but you can always use mass transit. so far there's no delay. we'll go outside show you some live traffic cameras. here's a live look at the south 101, near mckee in san jose and a few more cars hitting the roads at 5:15. taillights are moving southbound. northbound traffic looks good this morning heading towards

santa clara. we'll get a quick look at the san mateo bridge now where westbound 92 taillights that's the commute direction. so far looks great out towards the high-rise. 14 minutes out of hayward towards the other side. that's a check of your time- saver traffic. here's lawrence. >> you were loving it yesterday a lot of folks loving to see the heat for a while now. looks like this will be it and things will be changing. we're mild outside now, skies mostly clear. these temperatures running in the 50s and the 60s right now. so a very clear and mild start to the day. this afternoon, returning to triple digital inland especially in the east bay and gradual cooling toward tomorrow and some temperatures below average. strong ridge overhead and weak offshore wind, clear skies into sfo today no travel delays there expected at all into the afternoon.

stearns. the investment bank was acquired in 2008. new york's attorney general filed the suit and claims bear stearns misled investors about mortgage-backed securities. jpmorgan chase says it will fight the suit and noted that the alleged actions took place before it bought bear stearns. american express is paying $112 million in refunds and fines to settle accusations that it duped its customers. federal regulators say the credit card company charged unlawful late fees and deceived cardholders into paying off old debts or buying extra card services. amex will refund some $85 million to about 250,000 of et cetera customers. some verizon customers notice that it was using cell data even when connected to wi- fi putting them over limits. apple released an update to fix it and verizon won't charge for

the giants moved away in 2000. the 9ers will move to santa clara in 2014. >> but this morning, it's all about your oakland as. there will be some play-off baseball in oakland this year. the athletics clinched a post- season bid last night when they beat the rangers. the final out right there, what a season. they beat them 4-3. it's the first time in six years the as have made the play-offs. they still have a chance to win the western division, too. they have a little work to do. with the win, the as are one game behind texas for the a.l. west league. the as can win the division if they win their last two games against the ranger, tonight and tomorrow. if they win both they're n oakland is also tied for the top wild card spot with baltimore. they are in l.a. hoping to keep the dodgers out of the post-season but l.a. herrera drove in the winning run. bottom of the 9th inning, a little drama at dodger stadium giving l.a. a 3-2 victory keeping their

>> good morning, everyone. it's tuesday, october 2. i'm frank mallicoat. >> i'm michelle griego. time now is 5:30. we're following breaking news right now in vallejo. firefighters are battling a large house fire in vallejo. we have an unconfirmed report that two people escaped from the home. the fire happened on the 200 block of el camino real near vallejo senior high school just about 30 minutes ago, the solano county fire department requested air support from cordelia. we have a reporter heading to the scene right now. in the meantime, the oakland as are going to the play-offs. they clinched that spot last night with a big win a one run win over the rangers. cbs 5 reporter elissa harrington at the oakland coliseum where the team still has hopes of winning the division. sounds quiet there but it was rocking last night. >> reporter: it was. nothing like a win at home in front of thousands of screaming fans of. here's how it all ended.

>> he struck him out! and the oakland athletics -- >> reporter: more than 21,000 fans joined in on the celebration. it was wild. last night's win against the first place texas rangers, it was the 4-3 win, clinched the as one of the wild card spots in the play-offs. later on in the clubhouse corks were popping, champagne was flowing and as manager bob melvin got hit in the face with a pie. the as have also kept their division title hopes alive in the america league west cutting the rangers' lead to one game. the team has very young players, some in their early 20s, 15 rookies. they seemingly have been living in the shadow of of the giants for the past few years. both bay area teams are going into the post-season. last night rookie pitcher jarrod parker held the rangers to three runs and six hits and coco crisp had a go-ahead tunnel that gave the team a

bay area bridges so here you go. here's a live look at the san mateo bridge and so far in the commute direction of westbound 92, all those taillights so far looks great. 14 minutes is the drive time from hayward out towards foster city. bay area roads problem-free. hotspot free since we have been on the air for the last hour or so. northbound 880, 15 minutes or so, 15, 16 minutes between 238 and the maze. a three-alarm structure fire is now out. we have just confirmed that with emergency officials but a firefighter was hurt. we're not sure how badly. 200 block of el camino real is on city streets in the area. pretty close to vallejo senior high school. we have a crew almost on scene now so we'll bring you a live report shortly. in the meantime, it is no long he a "spare the air" day. obviously mass transit always a good option. and so far everything is on

san mateo and then taking her off campus last month. police say the girl got away by kicking the suspect and runningback into the school. other bay area headlines the body of one of the two missing fishermen washed ashore the san mateo county coast. the 18-foot fishing vessel capsized sunday. the second man is missing. neither were wearing life jackets. two other men were wearing life jackets and made it to shore safely. san rafael will consider strengthening its smoking ordinance at tonight's meeting. a proposal would ban smoking in duplexes and multi-family residential units including their indoor and outdoor common areas. there would be an allowance for a designated smoking area meeting certain criteria. they would have a year to comply with the ordinance if it passes. chevron is on the agenda when the richmond city council

this story. we'll pass more information when we get it. 5:48. stock futures are high they are morning after mixed results on the first day of trading in the new quarter. ashley morrison of cbsmarketwatch.com joins us. >> reporter: overseas markets were mixed this morning. the nikkei shed a fraction on concerns of company earnings while the hang seng is closed for holiday. dow up 77 yesterday while the nasdaq lost 2. stock futures are higher at this point this morning on that positive manufacturing report that we received yesterday. the tax policy center released a study showing americans of all different incomes could be hit with a tax increase if washington doesn't come up with a budget deal by the end of the year. if existing tax cuts are allowed to automatically expire, the average tax increase would be $3,500 a year, a middle income family making between $40,000 and $64,000 a year would see their
